Beyond Reasonable Doubt is a very high standard to meet. To authorize a conviction on circumstantial evidence, the proven facts must not [only] be consistent with the theory of guilt, but must also exclude . . . every other reasonable theory other than the guilt of the accused. This basically means that no other reasonable or logical explanation could be derived from the facts except the fact the defendant committed the crime.
Are you facing a conspiracy charge? Know that mere presence at the scene of a crime is insufficient evidence to support a conviction. However, common criminal intent may be established by showing a defendant presence and companionship before, during and after the crime was committed.
Guilt and Innocence is not black and white, it is determined by the very specific facts and nature of your matter, what the evidence supports and what it does not. The prosecutor must prove every element of a charge to receive a guilty verdict. Let us show the prosecutors case against you lacks a required element or the states theory is unreasonable and we may be able to secure the Not Guilty verdict in your case.
Come into the office to discuss your criminal matter.
